Official Rules

NO PURCHASE IS NECESSARY TO ENTER. A purchase or payment of any kind will not increase your chances of winning. By participating in the Promotion (defined below), participants agree to abide by these official rules (the “Official Rules”). The decisions of the Sponsor (as defined below) with respect to all aspects of the Promotion are final. The information you provide will only be used to administer the Promotion in accordance with the Sponsor’s privacy policy and will only be used by the Sponsor in connection with publicity relating to the Promotion. The Sponsor shall not be taken to make any representations, express or implied, as to the lawfulness of any individual's participation, or as to any other aspect of this Promotion.

  1. SPONSOR & PROMOTION PERIOD: The Clearly Canadian Summer Promotion (the “Promotion”) is sponsored by The Clearly Food and Beverage Company LLC (the "Sponsor") and administered by a non-affiliated Promotion administrator (“Administrator”). The Promotion commences at 12:00:00 AM Eastern Time (“ET”) on May 01, 2025 and will end at 11:59:59 PM ET on July 31, 2025 (the "Promotion Period"). All references in these Official Rules are Eastern Time, which shall control for all purposes of the Promotion. Administrator's computer is the official time-keeping device for the Promotion.
  2. ELIGIBILITY: The Promotion is open only to legal United States residents residing in the fifty (50) United States (including the District of Columbia and excluding, for clarity, Puerto Rico, the U.S. Virgin Islands and other U.S. territories and possessions) who are at least eighteen (18) years of age and the age of majority in their state of primary residence (19 in AL and NE, and 21 in MS) at the time of participation. Employees of Sponsor, its affiliates, subsidiaries, suppliers, advertising, Administrator and other Promotion agencies and anyone else connected with the production and distribution of the Promotion (collectively, the “Promotion Parties”) and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and/or those living in the same household of each are not eligible to participate or win. Void where prohibited. Participation constitutes participant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Promotion including but not limited to the administration and operation of the Promotion and the determination of the potential winners. Winning a prize is contingent upon fulfilling all requirements set forth herein.
  3. HOW TO PARTICIPATE IN THE PROMOTION: There are two (2) ways to participate in the Promotion:
    1. With Purchase: During the Promotion Period, scan the QR code found on Promotion advertising materials at participating retailers using the camera on your wireless phone and then click on the link to be redirected to the Promotion website or go directly to clearlycanadiancontests.com (the “Promotion Website”) and complete the registration form (the “Registration Form”) with your full name and your email address, select your state of residence from the dropdown menu and provide your daytime telephone number (including area code). Next, upload your sales receipt of any Clearly Canadian product purchased in the US between May 01, 2025 and July 25, 2025 (the “Purchase Period”) and select from the drop down menu the trip that you would like to win if selected for an Instant Win Prize (see rule 4 for trip options). Upon doing so, confirm that you are at least eighteen (18) years of age and the age of majority in your state of residence, confirm that you have read, understand and accept these Official Rules and indicate whether you would like to receive future notifications regarding upcoming events and/or promotions from the Sponsor (opting in is optional and has no bearing on your participation). Upon doing so, click “Play” to reveal if you have won a prize, subject to verification of eligibility and compliance with these Official Rules. If you are deemed as a potential winner of a prize, a notification will appear describing the prize you are eligible to receive (the “Congratulations Notification”) (the Instant Win Prizes are set out in rule 4) and an email will be sent to the email address provided in your registration to complete the winner verification process and prize fulfilment (see Rule 7). If you are not deemed a potential winner of a prize, a “Sorry, you are not a winner” notification (the “Sorry Notification”) will appear on screen informing you that you are not a potential prize winner.
    2. Without Purchase: During the Promotion Period, enter your No-Purchase Pin (see below on how to receive a No-Purchase PIN) on the Promotion Website and complete the Registration Form with your full name and your email address, select your state of residence from the dropdown menu and provide your daytime telephone number (including area code). Next, select from the drop down menu the trip that you would like to win if selected for an Instant Win Prize (see rule 4 for trip options) Upon doing so, confirm that you are at least eighteen (18) years of age and the age of majority in your state of residence, confirm that you have read, understand and accept these Official Rules and indicate whether you would like to receive future notifications regarding upcoming events and/or promotions from the Sponsor (opting in is optional and has no bearing on your participation). Upon doing so, click “Play” to reveal if you have won a prize, subject to verification of eligibility and compliance with these Official Rules. If you are deemed as a potential winner of a prize, a Congratulations notification will appear describing the prize you are eligible to receive, and an email will be sent to the email address provided in your registration to complete the winner verification process and prize fulfilment (see Rule 7). If you are not deemed a potential winner of a prize, a “Sorry Notification will appear on screen informing you that you are not a potential prize winner.

All game plays must be completed by 11:59:59 PM PT on July 31, 2025. Limit of one (1) game play per person per day during the Promotion Period. Sales receipts must be unique per Game play and may only be submitted once. Only one (1) email address per person is allowed. No person may participate more than once by using different email addresses and no email address can be used to participate more than once.  Game plays in excess of the limits stated herein shall be void and disqualified. Any person who is found to have participated in a fashion not sanctioned by these Official Rules and/or who has submitted more than the number of game plays permitted by these Official Rules will be disqualified. Proof of transmission (screenshots or captures, etc.) does not constitute proof of delivery. Game plays generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. The Sponsor will not be responsible for late, lost, illegible, falsified, damaged, misdirected, mutilated, garbled or incomplete Registration Forms, which will be void. All Game plays become the property of the Sponsor upon receipt and none will be returned.

By clicking “Play” you are confirming compliance with these Official Rules, and if selected for a prize, accepting of the prize as awarded, without substitution, and releasing the Promotion Parties, and their respective shareholders, directors, officers, employees and agents (collectively the “Releasees”) from and against all liability in connection with the Promotion and/or the awarding and use of any prize, and consenting to the use of your name, address (city and state), and/or photograph, without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor with respect to the Promotion.

HOW TO RECEIVE A NO-PURCHASE PIN: On a plain piece of paper, hand-print your full name, a valid email address, your state of residence and zip code, write a minimum 50-word essay on “Why Clearly Canadian is my favourite sparkling water Product” and mail to: Clearly Canadian Summer Promotion (Request for No-Purchase PIN), 401 N. Michigan Ave., Suite 1200, Chicago, IL, 60611.  Upon receipt of a complete request, a PIN will be sent to the email address provided. Each request must be unique and received on or before July 25, 2025, to allow sufficient time for emailing. Limit of one (1) No Purchase PIN mail-in request per outer envelope with sufficient postage.

  1. INSTANT WIN PRIZES: There are three (3) prizes (each an “Instant Win Prize”) available to be won during the Promotion Period, consisting of the winners’ choice of one (1) of the following three (3) trips as selected on the Registration Form:
    1. Katy Perry Concert: The Katy Perry Concert Prize includes roundtrip economy airfare for the winner and one (1) guest departing Tuesday August 19, 2025 and returning Thursday August 21, 2025 (as determined by Sponsor) from a US international airport closest to the winner’s residence (the “Departure Point”) to Hartsfield-Jackson Atlanta International Airport (airport, airline and flight itinerary to be determined by the Sponsor in its sole discretion); two (2) nights’ standard accommodation in Atlanta, GA, in a four-star hotel based on a single room, double occupancy as determined and selected by the Sponsor in its sole discretion; two (2) tickets to the Katy Perry Concert at State Farm Arena in Atlanta, GA on Wednesday August 20, 2025 (seating locations as determined by the Administrator in their sole discretion) and $500.00 (USD) spending money issued in the form of a cheque.
    2. Toronto Blue Jays Home Game: The Toronto Blue Jays Home Game Prize includes roundtrip economy airfare for the winner and one (1) guest departing Friday September 26, 2025 and returning Sunday September 28, 2025 from Departure Point to Pearson International Airport (airport, airline and flight itinerary to be determined by the Sponsor in its sole discretion); two (2) nights’ standard accommodation in Toronto, ON, in a four-star hotel based on a single room, double occupancy as determined and selected by the Sponsor in its sole discretion; two (2) tickets to the Toronto Blue Jays vs Tampa Bay Rays game at the Rogers Centre in Toronto currently scheduled to take place on Saturday September 27, 2025 (seating locations as determined by the Administrator in their sole discretion) and $500.00 (USD) spending money issued in the form of a cheque.
    3. Toronto Blue Jays Away Game: The Toronto Blue Jays Away Game Prize includes roundtrip economy airfare for the winner and one (1) guest departing Friday August 22, 2025 and returning Sunday August 24, 2025 from the Departure Point to Miami International Airport (airport, airline and flight itinerary to be determined by the Sponsor in its sole discretion); two (2) nights’ standard accommodation in Miami, FL, in a four-star hotel based on a single room, double occupancy as determined and selected by the Sponsor in its sole discretion; two (2) tickets to the Toronto Blue Jays vs Miami Marlins game at the LoanDepot Park Stadium in Miami, FL  currently scheduled to take place on Saturday August 23, 2025 (seating locations as determined by the Administrator in their sole discretion) and $500.00 (USD) spending money issued in the form of a cheque.

Should a winner select (ii) from the above options, such winner and their designated guest must possess a valid U.S. passport and provide a copy of same to Administrator prior to ticketing of the prize.  The valid U.S. Passport does not expire within 6 months of travel.

The total approximate retail value (“ARV”) of each Prize is $5,000.00 (USD) based on a Los Angeles, CA departure example. The actual retail value of the Prize may vary depending on the actual city of departure and standard fare/rate fluctuations in the air travel and hotel markets. No difference between the actual and approximate retail values will be awarded. Travel & hotel arrangements for winner and guest to be booked by Administrator following winner verification. Actual value may vary based on airfare fluctuations and distance between departure and destination.  Any difference between such approximate retail value and the actual value of the Prize as taken will not be awarded.  Each winner is responsible for all federal, state and local taxes on the Prize and costs and expenses not specifically listed above relative to the acceptance and use of the Prize including, without limitation, taxes, surcharges, service charges, meals, food, beverages, insurance, valid travel documentation, passports, transfers/transportation to and from the airports, car rentals, medical/health expenses, gratuities, excess baggage fees, communication charges, and all personal expenses and incidentals. Due to the nature of the Prize, the winner and their guest must be available to travel on the dates designated by Administrator, or the Prize will be forfeited and another participant may be randomly selected from all registered participants. Dates of departure and return are subject to change at Administrator’s sole discretion. The winner’s guest must be at least eighteen (18) and the age of majority prior to signing the requisite travel release in order to accompany the Prize winner as their guest. Travel arrangements are subject to availability, blackout dates and other restrictions. The Winner and their guest must travel on the same itinerary, have a valid U.S. passport and any necessary visas (with the term "valid" being defined as what is valid under Canadian and/or United States laws) required. There are no deviations to travel allowed. The Prize must be accepted as awarded and may not be sold or transferred and is not convertible to cash. If the Prize winner’s residence is in close enough proximity to Miami, FL and selected the Toronto Blue Jays away game Prize, as the Administrator determines in its sole discretion, the Administrator may provide ground travel in lieu of air travel with no further obligation to the Prize winner with respect to travel. The Prize winner will not receive cash or any other form of compensation if actual travel costs are less than the Prize ARV.

  1. The Sponsor reserves the right in its sole discretion to substitute the Prize in whole or in part with another prize or prize component of equal or greater value in the event that all or any component of the Prize is unavailable, or for any other reason.  If winner is unable to participate in the trip during the dates designated by Sponsor, the prize will be forfeited in its entirety.  In the event the prize winner is able to travel during the dates designated by Sponsor, but the event does not or cannot take place as scheduled or at all for reasons including but not limited to scheduling conflicts, cancellations, postponement, or for any other reason, then the Sponsor reserves the right to award the remainder of the prize with no further obligation to the winner.  The Prize must be accepted as awarded and may not be sold or transferred and is not convertible to cash.
  2. SEEDING OF INSTANT WIN PRIZES:  Using a computer algorithm, the Sponsor will randomly pre-select a series of "Winning Times" throughout the Promotion Period, each of which is associated with a single Instant Win Prize. The first person who clicks “Play” (as noted in rule 3 above), by following the steps in rule 3 above, on or after a Winning Time, shall be deemed a potential winner. At the beginning of the Promotion Period there will be three (3) prizes available to be won. As prizes are claimed, the number of prizes available will be reduced accordingly. It is possible that some prizes will remain un-awarded at the end of the Promotion Period. The odds of winning a prize depend on the number of eligible game plays and the time and date of those game plays.
  3. DECLARATION OF PRIZE WINNERS AND AWARDING OF PRIZES: To be declared a Prize Winner, a potential winner (and their guest) must complete, execute, have notarized and return an Affidavit of Eligibility, a Liability Release, and (where imposing such condition is legal) a Publicity Release as well as a W9 tax form (collectively, “Prize Claim Documents”). The Prize Claim Documents must be returned within the time period specified along with any other documentation that Sponsor may require.  If (a) the potential winner is determined to have been ineligible for any reason; (b) despite reasonable efforts, the potential winner does not respond within the time period specified thereon, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner; (c) the potential winner declines the prize; and/or (d) the potential winner fails to timely return completed and executed Prize Claim Documents (or such forms are returned as undeliverable), then such potential winner will be disqualified and, time permitting, the corresponding prize will, at Sponsor’s sole discretion, be reseeded into the prize pool or remain unawarded. The Sponsor shall have no liability if any winner notification is lost, intercepted or not received by a potential winner for any reason.
  4. GENERAL LIABILITY RELEASE/FORCE MAJEURE: Participants agree that the Promotion Parties (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Promotion or any Promotion -related activity or from a participants’ acceptance, receipt, possession and/or use or misuse of any prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to the prize, including, without limitation, to such prize’s quality or fitness for a particular purpose.  The Promotion Parties assume no responsibility for any damage to a participant’s or any other person’s computer system or wireless phone which is occasioned by participating in the Promotion, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature.  Without limiting the generality of the foregoing, the Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen entries, email or mail or prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information.  The Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the operation of the Promotion, to be acting in violation of these Official Rules, to have submitted a disqualifying game play, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Promotion, or to annoy, abuse, threaten or harass any other person, and the Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated multiple game plays will be accepted.  The Sponsor reserves the right to cancel, modify, suspend, or terminate the Promotion if it determines, in its sole discretion, that the Promotion is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Promotion. In the event the Sponsor is prevented from awarding a Prize or continuing with the Promotion as contemplated herein by any event beyond their control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal,  state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within the Sponsor’s control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Promotion. If the Promotion is terminated or suspended before the end of the Promotion Period, notice thereof will be posted on the Website and the Sponsor will (if possible) select the winner in a random drawing or drawings from all eligible, non-suspect game plays legitimately received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each participant’s sole and exclusive remedy under such circumstances. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. The Sponsor reserves the right to correct clerical or typographical errors in Promotion materials or these Official Rules.
  5. RIGHTS GRANTED BY YOU: By entering the Promotion and/or accepting a prize, each participant consents to the use of their user name, name, address (city and state), social media handles, and/or photograph without further compensation, in connection with any publicity carried out by or on behalf of the Sponsor with respect to the Promotion, except to the extent prohibited by law.  Further, by participating in this Promotion, you understand and agree that Sponsor, anyone acting on behalf of Sponsor, and Sponsor’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, name, portrait, picture, voice, likeness, image, statements about the Promotion, and biographical information for news, publicity, information, trade, advertising, public relations, and Promotion purposes without any further compensation, notice, review, or consent. 
  6. By participating the Promotion, participants agree to abide and be bound by these Official Rules and the decisions of the Sponsor respect to all aspects of the Promotion, which are final and binding in all respects relating to this Promotion. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend or cancel the Promotion or participant’s participation in the Promotion should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor’s control affect the administration, security or proper play of the Promotion or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Promotion as planned. Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Promotion. ALL DECISIONS BY SPONSOR ARE FINAL. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THESE OFFICIAL RULES, PLEASE DO NOT ENTER THE PROMOTION.
  7. The Promotion is subject to all applicable federal, state, and local laws and shall only be construed and evaluated according to applicable federal, state and local laws.
  8. The winner’s list will be made available upon request after September 30, 2025 (see rule 14). These Official Rules may be made in multiple language versions. In the event of a dispute as to the terms of different language versions, the English version shall prevail.
  9. CONSENT TO USE PERSONAL INFORMATION: The Sponsor respects your right to privacy. The information you provided will only be used for the purpose of administering this Promotion and prize fulfillment.
